Have Prosecutors Gone Too Far?
Check out this month's edition of the ABA Journal for an in-depth analysis of the Federal Government's ongoing investigation of plaintiffs securities class action law firm powerhouse Milberg Weiss Bershad & Schulman. Author Martha Neil poses the question "Should Law Firms Ever Be Indicted" and aptly notes that the makings of the Government's case against the law firm contains "all the elements of a John Grisham potboiler."
Indictment of an entire law firm, particularly one as large and prominent as Milberg Weiss, may very well be a first in American history. Yet attorneys at the firm are adamant that "they cannot, in good conscience, contribute to the erosion of the attorney-client privilege by knuckling under to the government's blackmail" - states the firm's Web site. "The firm therefore elected to reject the government's demand for broad privilege waivers and will fight the case in court."" See ABA Journal, Dec. 2006, at p. 39.
